Divorce
Protecting Your Interests Every Step of the Way

Ending a marriage is never easy, and the complex legal process can add to your emotional strain. At Jennifer Wiggins Moore Family Law, we focus on prioritizing your goals and helping you achieve them. Whether the divorce was initiated by you or your spouse, there are some key terms you should know to navigate this situation effectively.

asset-division

Division of Assets & Debts

A divorce is the division of all marital assets and debts. In Texas, we are a community property state meaning that assets and debts acquired during the marriage are generally considered equally owned by the spouses. However, they are not always divided equally. Additionally, you may have separate property, mixed character property, reimbursement claims, or waste/fraud claims. Jennifer understands the sensitivity and importance of these issues. She has extensive experience in handling asset valuation, characterization, and equitable division for real estate, retirement accounts, stock options, business interests, and other valuable assets.

Group 18
Fault in the Breakup of the Marriage

Does fault in the breakup of your marriage really matter? While most divorces in Texas are granted on no-fault grounds, sometimes it is strategic or even necessary to tell the court that this divorce is your spouse’s fault. How do you prove fault or how do you defend against it? The simple truth is that it may help you, hurt you, or be of no consequence at all. Jennifer will guide you on the pros and cons of fault in divorce, and help you choose if gas or water on the fire is your best bet.

maintenance

Spousal Maintenance

Most call it alimony, but in Texas, it’s called spousal maintenance. Are you entitled to it? How long will you have to pay? How much money are we looking at? Whether you are seeking spousal maintenance or may be required to pay it, Jennifer will work to ensure that any support arrangements are fair and reflect your unique financial situation.

Prenup
Pre-Nuptial and Post-Nuptial Agreements

Do I have to follow community property rules if my marriage ends? No. Carefully crafted pre-nuptial and post-nuptial agreements give you and your spouse the freedom and creativity to protect your financial futures. At Jennifer Wiggins Moore Family Law, we work closely with couples in Keller, Texas, to create personalized and enforceable agreements that clearly define the rules you and your spouse want to play by. Early planning can give you and your spouse both peace of mind should life take an unexpected turn.

Adapting to Life’s Changes
Modifications & Enforcement

Life circumstances can change, and when they do, you might need to modify an existing family law order, such as child custody, child support, or spousal maintenance. Whether you need to adjust support payments due to a change in income, relocate with your child, or alter custody arrangements, Jennifer helps ensure your modified orders reflect your current situation and best serve your family’s needs. It is also Jennifer’s job to let you know if your modification request is likely to be successful. We want you to have realistic expectations based on Jennifer’s broad experience. Modifications are tough. Jennifer is tougher!

In addition to modifications, Jennifer assists clients in enforcing existing court orders. If you’re facing challenges with a former spouse not complying with custody, support, or other family law orders, she will take the necessary legal steps to enforce these obligations so that your rights and your child’s well-being are protected.

Prioritizing Your Child’s Best Interests in
Custody Matters

Each family is different, and cookie-cutter parenting plans do not take into consideration your family’s individual needs. With Jennifer’s extensive experience crafting custom parenting plans, you’ll have knowledgeable guidance and strong support throughout the process. She’ll help you understand your custody, visitation, and support options and work toward an arrangement that provides a stable and nurturing environment for your children.

Who Gets Custody?
You may feel that judges are slanted toward awarding custody to mothers. Is that true? Do Texas courts favor mothers in making custody decisions? Can you really get an equal custody order in Tarrant County?

The standard in Texas in making a custody determination is “best interest of the child.” So how does the judge determine what the best interests of your child are? Here’s a list of common factors:

  1. Which parent can best provide for the child’s physical, psychological, and emotional needs and development now and in the future?
  2. Which parent has a more stable home? [The court may not consider marital status; however, marital stability is a factor the courts consider.]
  3. How much cooperation is there between the parents? The Court will consider each parent’s ability to give the child first priority and to reach shared decisions that are in your child’s best interest.
  4. Which parent has better parenting skills?
  5. Which parent has been serving as the child’s primary caregiver before the litigation?
  6. Which parent is better able to maintain close relationships between the child and other family members (grandparents, aunts, uncles, cousins, siblings, etc.)?
  7. Where do the parents reside in relation to each other?
  8. Can the parent encourage and promote a healthy relationship between the child and the other parent?
  9. Has there been a pattern or history of child neglect or physical or sexual abuse by one parent directed against the other parent, a spouse, or a child?
  10. Has there been any family violence?

If you’re facing a child custody battle, you should study this list. With Jennifer as your child custody attorney, you will have an expert by your side to help you position yourself as the type of parent you want to be after divorce or separation.
